■問題になった小説「石に泳ぐ魚」は1994年9月号の「新潮」に掲載されたが、私はた またまこの小説を読んだ。柳美里氏が初めて書いたこの小説は、登場人物がいきいき と描かれていて、芥川賞受賞作品「家族シネマ」よりもはるかに面白かった。件の女 性はたくましく描かれ、好印象を持った。読後感がさわやかだったのは、この女性の 存在が大きいと思う。だから、プライバシーの侵害で訴えられたと聞いた時には、何 かの間違いではないかと思った。
■言葉狩り、いわゆる差別用語も「表現の自由の制約」の代表格だが、これは言葉だ けを取り出して良い悪いを決めているからだ。個々の状況で決めれば表現の自由はそ れほど制約されないと思う。たとえば貧乏人に貧乏人と言えば、それは差別用語にな るかもしれないが、金持ちに貧乏人と言えば、それはユーモアだ。貧乏人という同じ 言葉が使われる状況によって大きく変わる。
■「石に泳ぐ魚」はこの女性を「金持ち」と描いている。でも、彼女は自分を「貧乏 人」と思った。この認識のずれは彼女を取り巻く状況にあるのだろうが、ここには表 現の自由以上に大切で、根深い問題があると思う。柳美里氏はこの点を彼女と話し合 ったのだろうか。
■判決は生きる勇気を与えてくれたとこの女性は言った。私も最高裁の判決は正しい と思うが、差別用語をまたひとつ増やしただけで、根本的には何も解決していない気 がする。でも、どうしたら根本的に解決するのだろう。
